Chester County Chamber of Commerce Partners with Other Business Groups Urging Congress to Oppose Noncompete Rule
|
CCCBI joined business groups across the Commonwealth and Nation to urge the US Congress to oppose the Federal Trade Commission’s (FTC) proposed rule to impose a nationwide ban on almost all noncompete contracts. As stated in a letter signed by Laura Manion, President of CCCBI, the FTC lacks the constitutional or statutory authority to issue such a rule and, in attempting to do so, the agency is improperly usurping the role of Congress.
Contractual relationships between employers and employees are beneficial to spur innovation when companies feel they can freely share information with their workforce to increase trust and productivity. A survey by the US Chamber of Commerce found employers would have to reduce the sharing of sensitive information with employees, and reduce or defer compensation with employees should this ban take effect. In addition, non-compete contracts can be a more effective, and lower cost manner in preventing the loss of trade secrets than a litigation alternative which would further clog the courts (Brookings).
However, this change by the FTC would invalidate millions of contracts around the country which will harm both employees and employers. For more information, please click here.
